a device with internet access;

an up-to-date web browser;
-
an active email address;
-
for digital products, a device and software capable of downloading, saving and opening the relevant file format.
Using the Store may involve the usual risks associated with the internet. The Customer should use up-to-date software and device security measures and protect their account login details and file download links.

§ 3. Rules for using the Store
The Customer must use the Store in accordance with the law, these Terms and Conditions and accepted standards of conduct.
The following are prohibited:
-
submitting unlawful content;
-
taking action that disrupts the Store’s operation;
-
bypassing technical safeguards;
-
attempting to gain unauthorised access to data or systems;
-
using the Store in a way that infringes the rights of the Seller or third parties;
-
automatically downloading, copying or indexing Store content in a manner that disrupts its operation.
The Customer should provide truthful, complete and up-to-date information.
The Customer is responsible for keeping their account login details and individual Digital Product download links confidential.
The Customer should promptly inform the Seller if they suspect unauthorised use of their account or download link.
§ 4. Product and service information
Information published in the Store, including descriptions, photographs, visualisations, prices and product specifications, constitutes an invitation to enter into a contract rather than an offer within the meaning of the Polish Civil Code.
The Seller exercises due care to ensure that information in the Store is accurate and up to date.
Photographs and visualisations aim to present the product as faithfully as possible. Colours displayed on a screen may differ from actual colours due to device and monitor settings and lighting conditions.
Products made of wood, metal or other natural materials may exhibit natural differences in colour, grain, texture and shade. These do not constitute a lack of conformity with the Contract if they do not affect the Goods’ agreed characteristics and functionality.
Handcrafted and individually manufactured products may show minor differences from photographs or visualisations resulting from the manufacturing process, provided that the agreed product characteristics are maintained.
The specifications, formats, dimensions, licence scope, technical requirements and contents of a Digital Product are stated in its description.
Before purchasing a Digital Product, the Customer should check that they have the hardware, software and skills necessary to use the specified format.
A Digital Product consisting of a model or technical documentation may require further manufacturing preparation appropriate for the particular machine, tool, material or production process.
Unless the product description expressly states otherwise, purchasing a Digital Product does not include:
-
physical manufacture of the product;
-
preparation of an individual CNC or CAM program;
-
adaptation of the model to a particular machine;
-
selection of tools and machining parameters;
-
technical support beyond providing a correct file.
§ 5. Orders and conclusion of the Contract
Orders may be placed through the Store at any time.
To place an Order, the Customer:
-
selects a Product or Service;
-
reviews its description, price and terms of sale;
-
adds the Product to the shopping cart;
-
provides the required information;
-
selects an available payment method and, for Goods, a delivery method;
-
accepts these Terms and Conditions and makes the required declarations;
-
uses the button confirming an Order with an obligation to pay.
Before placing the Order, the Customer can review and correct the information entered.
Placing an Order constitutes an offer by the Customer to enter into a Contract with the Seller.
After receiving the Order, the Seller sends an acknowledgement to the Customer’s email address.
The Contract is concluded when a message confirming acceptance of the Order for fulfilment is sent to the Customer, unless the communication sent by the Store clearly indicates a different time of conclusion.
The Order confirmation contains essential Order information and enables information concerning the concluded Contract to be retained.
Before concluding the Contract, the Seller may refuse to accept an Order, particularly if:
-
the Product is unavailable;
-
there is an obvious error in the price or description;
-
the information provided is incomplete or incorrect;
-
the required payment has not been received;
-
the Order breaches the law or these Terms and Conditions;
-
there is a reasonable suspicion of fraud or misuse.
If an Order is not accepted, the Seller will promptly inform the Customer and refund the payment received using the same payment method, unless the Customer agrees to another refund method.
These Terms and Conditions do not restrict the Seller’s and Customer’s right to agree individual terms for a Service or Custom-made Product.
§ 6. Prices, taxes and payments
Prices displayed in the Store are expressed in Polish zlotys unless another currency is specified for the relevant market or Order.
The price shown to the Customer before placing the Order is a gross price including required taxes, unless expressly stated otherwise in an offer addressed exclusively to business customers.
The total Order price, including taxes and any delivery costs or other charges, is presented before the Order is placed.
Sales to another country may involve customs duties, import taxes or other public charges. Information on how these are settled will be provided to the Customer where required and ascertainable before the Contract is concluded.
Available payment methods are presented during the ordering process. They may include, in particular:
-
card payments;
-
Shopify Payments;
-
PayPal;
-
other methods available in the Store.
Payments may be processed by an external payment provider under its own terms.
The Seller does not store the Customer’s full payment card details.
If payment fails, the Contract may not be concluded or Order fulfilment may be suspended until payment is received.
Discount codes and promotions:
-
apply for the period and on the terms stated for the relevant promotion;
-
may apply only to selected products or customers;
-
cannot be exchanged for cash;
-
cannot be combined with other promotions unless the promotional terms provide otherwise;
-
may be cancelled where there is a reasonable suspicion of misuse.
When announcing a price reduction, the Seller states the lowest price applied to the product during the 30 days before the reduction, where required by law.
§ 7. Delivery of Physical Products
Available delivery methods, costs and estimated delivery times are presented in the Store no later than before the Order is placed.
Order fulfilment time may include:
-
preparation or manufacture of the Goods;
-
handover of the shipment to the carrier;
-
estimated transit time.
For custom-made Goods, the fulfilment time may be agreed individually.
Unless the parties agree otherwise, the Seller will deliver the Goods without undue delay and no later than the deadline required by applicable law.
The Seller remains responsible to the Consumer for the shipment until it is handed over to the Consumer, unless the Consumer independently selected a carrier not offered by the Seller.
Where possible, the Customer should check the shipment’s condition upon receipt. Recording packaging damage and preparing a damage report with the carrier may assist in handling a complaint, but the absence of such a report does not remove the Consumer’s statutory rights.
If the Customer provides an incorrect or incomplete address, they may be responsible for reasonable additional reshipping costs where the error is attributable to them.
The Seller is not responsible for delays resulting solely from circumstances for which it is not liable, subject to the Consumer’s mandatory rights.
§ 8. Delivery of Digital Products
Digital Products are supplied electronically:
-
through a link sent to the Customer’s email address;
-
on the Order confirmation or Order status page;
-
through the Customer’s account;
-
by another method stated in the Product description.
The Digital Product will be made available after payment is confirmed, unless the Product description or an individual agreement provides otherwise.
The Customer must provide a correct email address and check their junk or spam folder.
If the message containing the link does not arrive or the file cannot be downloaded, the Customer should contact the Seller at kontakt@vimtech.pl.
The Customer should download the file and make a backup copy. Future availability of the link may be limited as stated in the Product information. Such a limitation does not affect the Customer’s rights where Digital Content is not in conformity with the Contract.
The download link is intended for the Customer who made the purchase. Sharing the link with third parties is prohibited.
The Seller may temporarily block the link where there is a reasonable suspicion of unlawful distribution. The Customer may contact the Seller to clarify the situation.
The Seller supplies Digital Content in the version and format described on the Product page.
The Seller is responsible for the conformity of Digital Content with the Contract in accordance with applicable law.
§ 9. Licence for Digital Products
Purchasing a Digital Product does not transfer economic copyright in the design, model, documentation or source file to the Customer.
Upon full payment, the Customer receives a non-exclusive, non-transferable licence to use the purchased Digital Product within the scope specified in these Terms and Conditions and the relevant Product description.
Unless the Product description states otherwise, the Customer may:
-
download and store the purchased file;
-
use the file for their own purposes;
-
adapt the model’s dimensions and parameters to their own manufacturing technology;
-
manufacture physical products using the file;
-
sell finished physical products made using the purchased model.
Without VIMTech’s prior written consent, the following are prohibited:
-
selling, reselling, sublicensing or transferring the digital file to third parties, whether for payment or free of charge;
-
publishing the file or any part of it online, in cloud storage, a repository, group, social media platform or file library;
-
including the file or any part of it in the Customer’s own digital packages, offers or collections;
-
offering downloads of the file through a subscription, membership or other service;
-
selling a modified file or parts of it as the Customer’s own digital product;
-
sharing the file with a subcontractor, unless this is necessary solely to manufacture a product for the Customer, the subcontractor is bound by confidentiality obligations and retains no copy of the file;
-
removing copyright notices or information identifying the author;
-
using the Product in a manner that breaches the law or infringes third-party rights.
The sale of a finished physical product must not imply that VIMTech manufactured or certified it or is responsible for how the Customer made it.
The Customer is responsible for:
-
selecting materials, tools, machinery and manufacturing parameters;
-
preparing the manufacturing process;
-
checking dimensions, tolerances and safety;
-
ensuring that the manufactured product complies with the laws and requirements applicable to its intended use.
The licence is granted for the duration of economic copyright and without territorial restrictions, unless the Product description states otherwise.
A material breach of the licence terms may result in termination of the licence after the Customer has first been asked to cease the infringement, where the nature of the infringement allows such a request.
Specific licence terms in the Product description take precedence over the general provisions of this section.
§ 10. Services and individual orders
The scope, price, completion date and method of delivering the result of a Service may be specified in the Service description, an offer, an email or another agreement with the Customer.
Before work begins, the Customer should provide the Seller with complete and correct data, requirements, dimensions, files and any other information needed to perform the Service.
The completion date may be adjusted appropriately if the Customer:
-
delays providing required materials or information;
-
changes the previously approved scope;
-
fails to provide a response needed to continue the work.
Additional work outside the originally agreed scope requires a separate agreement and may involve additional fees.
The Customer is responsible for the lawfulness of materials supplied to the Seller and for holding the rights necessary to use them to fulfil the Order.
Where work is based on dimensions or data supplied by the Customer, the Seller is not responsible for the consequences of inaccuracies unless the error was obvious and should have been noticed by the Seller exercising due care.
The transfer of economic copyright or granting of a licence for an individually created design requires a separate, express agreement. Payment for the Service alone does not automatically transfer economic copyright beyond the scope arising from the contract or law.
§ 11. Right of withdrawal
Consumers and Business Customers with Consumer Rights may generally withdraw from a distance Contract within 14 days without giving a reason.
The withdrawal period is:
-
for a contract for the sale of Goods, 14 days from the day the Consumer or a third party designated by them, other than the carrier, takes possession of the Goods;
-
for a contract covering multiple Goods delivered separately, 14 days from taking possession of the last item;
-
for a Service contract, 14 days from conclusion of the Contract;
-
for a contract to supply Digital Content not supplied on a tangible medium, 14 days from conclusion of the Contract, subject to the exceptions below.
To exercise the right of withdrawal, an unequivocal statement must be sent before the deadline:
-
by email to kontakt@vimtech.pl or
-
by post to: VIMTech, ul. Adama Mickiewicza 3/4, 59-800 Lubań, Poland.
The Customer may use the statutory model withdrawal form, but this is not mandatory.
When withdrawing from a contract for the sale of Goods, the Consumer should return the Goods without undue delay and no later than 14 days after sending the withdrawal statement, to the address indicated by the Seller.
The Consumer bears the direct return cost unless the Seller has agreed to bear it or has failed to inform the Consumer of this obligation.
The Seller will refund the payments received, including the cost of the least expensive standard delivery offered in the Store, no later than 14 days after receiving the withdrawal statement.
The Seller may withhold the refund until the Goods have been received or proof of return has been provided, whichever occurs first.
The refund will use the same payment method used by the Customer, unless the Customer expressly agrees to another method that incurs no costs for them.
The Consumer is responsible for any reduction in the value of the Goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
If performance of a Service began at the Consumer’s express request before the withdrawal period expired and the Consumer subsequently withdraws before full performance, the Consumer must pay for the service provided up to the time of withdrawal.
The right of withdrawal does not apply, among other things, to contracts:
-
for Services fully performed by the Seller with the Consumer’s prior express consent, where the Consumer was informed and acknowledged that they would lose their right of withdrawal after full performance;
-
concerning non-prefabricated Goods made to the Consumer’s specifications or intended to meet their personalised needs;
-
concerning Goods liable to deteriorate or expire rapidly;
-
concerning sealed Goods that cannot be returned for health protection or hygiene reasons once unsealed, where the packaging has been opened;
-
for Digital Content not supplied on a tangible medium, where the Seller began supply with the Consumer’s prior express consent after informing them of the loss of the right of withdrawal, the Consumer acknowledged this, and the Seller provided the required confirmation of the Contract.
Before making a Digital Product available within the 14-day withdrawal period, the Store may require the Customer to tick a checkbox concerning:
-
consent to begin supplying Digital Content before the withdrawal period expires;
-
acknowledgement that the Consumer will lose their right of withdrawal once supply begins.
The absence of a right to withdraw from properly supplied Digital Content does not restrict the right to complain if the Digital Content is not in conformity with the Contract.
If the Seller offers a more favourable voluntary returns policy, its detailed terms are set out in the Returns Policy available at https://vimtech.pl/en/policies/refund-policy. A voluntary returns policy does not restrict statutory rights.
§ 12. Complaints concerning Physical Products
The Seller is responsible to Consumers and Business Customers with Consumer Rights for the conformity of Goods with the Contract under the Polish Consumer Rights Act.
Goods conform to the Contract where, in particular, their description, type, quantity, quality, completeness, functionality and suitability match the Contract and reasonable expectations arising from the nature of the Goods and the Seller’s public statements.
Complaints may be submitted:
-
by email to kontakt@vimtech.pl;
-
by post to: VIMTech, ul. Adama Mickiewicza 3/4, 59-800 Lubań, Poland.
Where possible, a complaint should include:
-
the Customer’s first and last name;
-
the Order number;
-
a description of the lack of conformity;
-
the date it was discovered;
-
the remedy requested by the Customer;
-
photographs or other materials that help assess the issue.
The absence of any of these elements does not automatically result in rejection of the complaint if the Order and subject of the complaint can be identified.
The Consumer may request repair or replacement of the Goods, subject to the exceptions provided by law.
In cases provided for by law, the Consumer may declare a price reduction or withdraw from the Contract.
The Seller will respond to a Consumer’s complaint within 14 days of receiving it.
The Seller bears the costs of collecting, repairing or replacing Goods recognised as not in conformity with the Contract, in accordance with the law.
If a guarantee is provided for the Goods, its terms will be presented in a separate document. The guarantee does not restrict statutory rights concerning a lack of conformity of the Goods with the Contract.
§ 13. Complaints concerning Digital Products and Services
The Seller is responsible for the conformity of Digital Content and Services with the Contract in accordance with applicable law.
If Digital Content has not been supplied, the Consumer may request that the Seller supply it. If the Seller fails to do so without undue delay or within an additional period agreed by the parties, the Consumer may withdraw from the Contract in the cases provided for by law.
If Digital Content is not in conformity with the Contract, the Consumer may request that it be brought into conformity.
In cases provided for by law, the Consumer may request a price reduction or withdraw from the Contract.
A complaint concerning a Digital Product may relate, in particular, to:
-
inability to download the file;
-
a corrupted file;
-
receipt of a file other than the one ordered;
-
missing elements specified in the description;
-
a format or essential characteristics that do not match the Product description.
A file’s incompatibility with software, equipment or a manufacturing process not identified as supported in the Product description does not constitute a lack of conformity with the Contract.
Complaints do not cover difficulties caused solely by the Customer’s lack of suitable software, technical knowledge or equipment where the requirements were clearly stated before purchase.
Complaints may be sent to kontakt@vimtech.pl.
The Seller will respond to a Consumer’s complaint within 14 days.
If a complaint is justified, the Seller may, as appropriate:
-
provide the correct file again;
-
replace or repair the file;
-
supply missing elements;
-
reduce the price;
-
refund the price where this follows from the Customer’s request and applicable law.
§ 14. Customer responsibility for the use of documentation
Models, drawings and technical documentation should be verified before use in production, particularly regarding:
-
dimensions;
-
tolerances;
-
material;
-
manufacturing technology;
-
strength;
-
safety;
-
compatibility with machinery and software;
-
legal requirements for the intended use.
Digital Products intended for decoration, crafts or artistic machining should not be used as designs for structural, protective or health- and safety-related components unless expressly developed and identified for such use.
The Customer is responsible for how an item made using the purchased file is manufactured and used.
This section does not exclude the Seller’s responsibility for a Digital Product’s lack of conformity with the Contract or liability for damage that cannot legally be excluded.
§ 15. Liability towards business customers
This section applies only to Customers who are business customers and are not Business Customers with Consumer Rights.
To the fullest extent permitted by law, the Seller’s liability towards a business customer is limited to actual loss and excludes lost profits.
The Seller’s total liability associated with a particular Order may not exceed the gross value of that Order, except where such a limitation is prohibited by law.
The Seller is not liable for:
-
consequences of using a file without prior verification;
-
inappropriate selection of technology, material, tools or parameters;
-
changes made by the Customer or third parties;
-
use of a Product contrary to its description, instructions or intended purpose;
-
loss of data resulting from the Customer’s failure to make a backup.
These limitations do not apply to intentionally caused damage or liability that cannot be excluded or limited under mandatory law.
§ 16. Intellectual property of the Store
Content available in the Store, including the VIMTech name, logo, graphics, photographs, models, texts, website layout, videos, designs and technical materials, may be protected by copyright, industrial property rights or other laws.
Using the Store does not transfer any rights in this content to the Customer.
Without the rights holder’s prior consent, copying, distributing, modifying or commercially exploiting Store content is prohibited, except for uses permitted by law or by a licence granted when purchasing a Product.
Trademarks and identifying marks belonging to other entities remain the property of their respective owners.
§ 17. Personal data and cookies
The rules for processing personal data are described in the Privacy Policy available at:
https://vimtech.pl/en/policies/privacy-policy
Information about cookies and similar technologies is provided in the Privacy Policy and in the privacy or cookie preferences panel, if available in the Store.
The Store operates on the Shopify platform. Certain data may be processed by Shopify and providers of apps necessary to handle Orders, payments, consents and Digital Products.
§ 18. Out-of-court dispute resolution
Consumers may use out-of-court procedures for handling complaints and pursuing claims.
Information about available assistance can be obtained, among other places:
-
from a municipal or district consumer ombudsman in Poland;
-
from the Polish Trade Inspection;
-
on the website of the Polish Office of Competition and Consumer Protection: https://uokik.gov.pl;
-
on the website of the consumer alternative dispute resolution system: https://polubowne.uokik.gov.pl;
-
for cross-border disputes, through the European Consumer Centre: https://konsument.gov.pl.
Using an out-of-court dispute resolution procedure is voluntary and may require both parties’ consent.
The Seller does not make a general commitment to use a particular alternative dispute resolution body unless required by law or agreed by the Seller in a specific case.
§ 19. Changes to these Terms and Conditions
The Seller may amend these Terms and Conditions for important reasons, particularly in the event of:
-
changes in the law;
-
changes to payment or delivery methods;
-
introduction of new products, services or features;
-
changes to technical solutions;
-
the need to improve security;
-
changes to the Seller’s details.
Amendments do not affect Orders placed before they take effect. Such Orders remain subject to the Terms and Conditions in force when they were placed, unless the change benefits the Customer and the Customer agrees to its application.
The current version of these Terms and Conditions is available in the Store together with the date of its last update.
§ 20. Final provisions
Contracts concluded by the Seller are governed by Polish law.
The choice of Polish law does not deprive the Consumer of protection afforded by mandatory provisions of the law of their country of habitual residence where those provisions apply.
Matters not regulated by these Terms and Conditions are governed by applicable law, particularly:
-
the Polish Civil Code;
-
the Polish Consumer Rights Act;
-
the Polish Act on the Provision of Electronic Services;
-
personal data protection legislation.
No provision of these Terms and Conditions excludes or limits the rights of Consumers or Business Customers with Consumer Rights arising from mandatory law.
If any provision is found to be invalid or unenforceable, the remaining provisions remain in force.
Disputes with Consumers will be resolved by the competent court determined under applicable law.
For disputes with business customers who are not Business Customers with Consumer Rights, the court having jurisdiction over the Seller’s registered place of business will be competent, unless mandatory law provides otherwise.
These Terms and Conditions take effect on 21 September 2026.
